Nocturne is a transparent web proxy — it does not host, store, or serve copyrighted content. All traffic originates from third-party websites requested by the user.

Role of the Operator

Nocturne operates as a mere conduit under the Digital Millennium Copyright Act (17 U.S.C. § 512(a)). The operator does not select, modify, or retain the content that flows through the proxy. As such, takedown requests are typically more appropriate to direct to the original host of the material.

Submitting a Notice

If you are a copyright owner and believe material hosted on this domain infringes your rights, send a written notice to the operator of this Nocturne instance including:

1. Your physical or electronic signature.
2. Identification of the copyrighted work claimed to have been infringed.
3. The exact URL on this domain where the material resides.
4. Your contact information (name, address, phone, email).
5. A statement that you have a good-faith belief that the use is not authorized.
6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-Notice

If you believe content was removed in error, you may submit a counter-notice with equivalent information and a statement, under penalty of perjury, of good-faith belief that the material was removed as a result of mistake or misidentification.

Repeat Infringers

The operator maintains a policy of terminating access for users who are repeat copyright infringers. Any IP address associated with multiple valid takedown notices may be permanently blacklisted.

Misuse

Knowingly submitting a false DMCA notice may subject you to liability under 17 U.S.C. § 512(f), including damages and attorney's fees.
